Enzo Biochem Reports Delaware Court Ruling
NEW YORK--(BUSINESS WIRE)-- Enzo Biochem Inc. (NYSE:ENZ) reported today that a federal judge for the U.S. District Court for the District of Delaware has entered an order in the actions entitled Enzo Life Sciences, Inc. v. Gen-Probe Incorporated, Enzo Life Sciences, Inc. v. Hologic, Inc., Enzo Life Sciences, Inc. v. Roche Molecular Systems, Inc., and Enzo Life Sciences, Inc. v. Becton, Dickinson and Company, denying summary judgment that U.S. Patent No. 6,992,180 (“the ‘180 Patent”) is invalid for lack of written description, but granting summary judgment that the ‘180 Patent is invalid for lack of enablement.
The ruling addresses only one patent at issue in the ongoing patent infringement actions between Enzo and the defendants in each case. At least one other Enzo patent remains pending against each defendant in those or parallel actions. Enzo believes that the Court’s ruling was in error, and is exploring options for review of the decision.
